Supreme Court maintains elected officials ought to resign for filing candidacy in local election



KATHMANDU: The Supreme Court has maintained that the local level people’s representatives will have to resign from their posts before registering their nominations in the May 13 local level elections.

The Supreme Court on Tuesday, quashing its previous stay order, paved way for the implementation of the election code of conduct issued by the Election Commission (EC) that mandated elected officials to resign before filing candidacy in the upcoming local polls.

A division bench of Justices Tej Bahadur KC and Til Prasad Shrestha decided to dismiss a writ petition filed by Chairperson of Helambu Rural Municipality, Sindhupalchowk, Nima Galgen Sherpa, challenging the EC condition.

The EC has fixed April 24 and 25 for filing candidacy in the local elections.
