Law student files case at Surkhet High Court seeking dismissal of Minister in Karnali Province



KATHMANDU: Law student Binita Bogati has filed a case in the Surkhet High Court seeking the dismissal of Karnali Minister of Industry, Tourism, Forest and Environment Chhiring Damdol Lama, citing he is a convicted felon and unfit for office.

The Karnali government, the Chief Minister and the Office of the Council of Ministers are defendants in the case. Chief Minister Jeevan Bahadur Shahi had appointed Lama as Minister last week.

The court had sentenced Lama to two years in prison and a fine of Rs  5,000 for stealing idols from Khochyarnath Gumba in Taklakot on December 11, 1994.

The petition stated that it is irresponsible of the provincial government to appoint a convicted felon as Minister.

Bogati said the government indiscriminately appointed people to various posts without giving due attention to one’s qualifications and abilities, contrary to the spirit of Constitution of Nepal.

Meanwhile, the writ called for stopping the newly appointed minister from carrying out duties and participating in the official programs until the final verdict in the case arrives.

The first hearing of the case is scheduled for at 10 am Tuesday, according to the Surkhet High Court.

Petitioner Bogati said that being a law student of Karnali Province, she filed the case. “I will confidently take this issue forward at the court,” she added.
