SC receives writ demanding not to implement Parliament Secretariat’s letter

KATHMANDU: The Supreme Court (SC) has received a writ petition demanding not to implement the Federal Parliament Secretariat’s letter about suspended Chief Justice Cholendra Shumsher Rana’s impeachment.

The Secretariat has given Jabara a letter to suspended CJ Rana declaring the impeachment motion filed against him has been ineffective as the term of the then House of Representatives expired.

Senior advocate Purnaman Shakya and others submitted a writ petition at SC on Wednesday urging it not to implement the Parliament Secretariat’s verdict on the impeachment motion still under the consideration of the parliament.

According to Ananta Raj Luitel, a member of the Supreme Bar Association, the writ has argued that the Parliament Secretariat’s letter given to suspended CJ Rana is illegal deserves cancellation by the apex court.

Although Rana had prepared to go to court at 3 pm today, he did not turn in the court.  As soon as they got the information about his preparations to join Supreme Court, the Nepal Bar Association (NBA) officials and other legal professionals gathered in the court premises and organized a sit-in.

As the office hours are over after 4 pm, the SC staffs have also left the court premises.

NBA has informed that the sit-in has been postponed till 10 am on Friday. An official of the bar said that since tomorrow Thursday is a public holiday, the dharna will be held only on Friday.

According to sources, Rana could not appear on Wednesday after the Ministry of Home Affairs also issued a circular to the police to prevent him from entering the court.

The term of the suspended Chief Justice Jabra is ending on December 13.
