HoR dissolution is a constitutional issue, not political: Senior Advocate Kharel

KATHMANDU: Senior Advocate Satish Krishna Kharel, speaking on behalf of amicus curiae at the Constitutional Bench at the Supreme Court (SC) Wednesday, has labeled the dissolution of the House of Representatives (HoR) as a constitutional issue rather than a political one.

Taking part in the debate taking place before the Constitutional Bench on the issue of the HoR dissolution, he argued that the dissolution of the HoR was a constitutional issue.

Speaking on behalf of amicus curiae Kharel argued against the government attorney’s and Prime Minister KP Oli’s claim that there should be no legal review on the dissolution issue as the dissolution of the HoR was a political issue.

“Selection of the Minister by the Prime Minister (PM) is related to the political decision, however, the dissolution of HoR is a constitutional issue,” he argued.

“However, whether there will be the next Prime Minister or not after the restoration of parliament is a political issue,” he added.

Out of five amicus curiae, Supreme Court sought to speak on the issue of dissolution of HoR, Senior Advocate Kharel is the second to take part in the debate.

Earlier, Senior Advocate, Badri Bahadur Karki had spoken on behalf of amicus curiae on Tuesday.
