KATHMANDU: The Constitutional Bench of Supreme Court has resumed the hearing on the writ petitions filed against the dissolution of the House of Representatives (HoR) despite the government attorneys’ Sunday protest against bench formation.
The Attorney General and other lawyers of his side had raised questions about the two Justices in the bench on Sunday and sought the removal of Justices Deepak Kumar Karki and Ananda Mohan Bhattarai.
The Bench had failed to start the hearing on the issue on Sunday owing to the protest from the government lawyers.
The Bench could not continue hearing on the case as Chief Justice Cholendra Shumsher Rana got unwell on Monday and Tuesday.
Resuming the Wednesday’s hearing on the writ petitions against the dissolution of HoR, Justice Ishwor Prasad Khatiwada ruled that no complaints about the Bench formation are welcomed now onwards.
“This Bench has been formed as per the prevalent legal and constitutional provisions, the irrelevant concern took too much time. So, please concentrate on the issue and proceed the debate on the topic,” Justice Khatiwada said on Wednesday, adding, “The concerns expressed by the esteemed lawyers are already taken under notice.”
Earlier, last week, after the lawyers representing writ petitioners against the dissolution of the House of Representatives claimed two of then justices of the Constitutional Bench had conflict of interest in the case, Chief Justice Rana had reformed the Bench including senior justice from the roster.
The incumbent bench comprises Chief Justice Rana, Justices Deepak Kumar Karki, Mira Khadka, Ishwar Prasad Khatiwada and Ananda Mohan Bhattarai.
Justice Khatiwada urged all lawyers to abide by the time allocated to each speaker and announced that each speaker has been given half an hour for the debate.
