Justice Subedi not qualified for the SC post: SC Bar

KATHMANDU: The Supreme Court (SC) Bar Association has concluded that Nahakul Subedi does not qualify for the post of Supreme Court judge.

Submitting a memorandum to the Parliamentary Hearing Committee on Friday, SC Bar has urged the committee to be serious over Subedi’s eligibility dispute.

The February 7 meeting of SC Judicial Council had recommended the names of Dr. Kumar Chudal and Nahakul Subedi for the post of Supreme Court judges. Now they are preparing for a parliamentary hearing. A complaint has been lodged in the committee alleging that Subedi was not qualified.

Earlier, a meeting of the advisory committee of SC Bar held on Wednesday had also stressed on the need to draw the attention of the hearing committee towards Subedi’s eligibility issue.

Accordingly, the Bar handed over a memorandum to Hearing Committee chairman Laxman Lal Karna.

The Bar has cited that Subedi does not qualify for the post as per Article 129 (5) of the Constitution.

“There are many senior judges in the high court. We have asked the parliamentary committee to look into his recommendation even though he is not qualified,” said a member the Bar.

SC is scheduled to give its verdict on a case filed against Subedi’s appointment on April 12.
