KATHMANDU: Spokesperson of Nepal Communist Party (NCP) Prachanda-Nepal faction Narayankaji Shrestha has said that the Supreme Court (SC) has the right to interpret the constitution and not to amend it.
He made the remarks while addressing the National Assembly on Friday on the issue currently sub-judice at the court regarding the dissolution of the House of Representatives by Prime Minister KP Oli.
“The Supreme Court will decide according to the constitution. I believe in the independent role of the courts. The decisions are based on the constitution. The apex court doesn’t have the right to amend the constitution. It has been entrusted with the right to interpret the constitution and make decisions under it,” Shrestha said.
Shrestha said that it was unconstitutional for Prime Minister Oli to dissolve the parliament.
‘The current constitution does not give the prime minister the right to dissolve the House of Representatives. That is why it is unconstitutional. The constitution cannot be assassinated,” he said.
He said that the party could be united if the House of Representatives was reinstated.
