KATHMANDU: The hearing of the Supreme Court (SC) on the dissolution of the House of Representatives (HoR) scheduled for today has been adjourned for Wednesday due to the health problem of Chief Justice Cholendra Shumsher Rana.
The SC hearing has been postponed for Wednesday due to the poor health condition of Chief Justice Rana, informed Supreme Court.
Earlier, the next date for hearing on the case of dissolution of the HoR had been set for today.
Though the discussions began on Sunday in the constitutional bench comprising Chief Justice Cholendra Shumsher JB Rana, Justices Deepak Kumar Karki, Meera Khadka, Ishwor Prasad Khatiwada, and Dr Ananda Mohan Bhattarai, the hearing could not take place focusing on the issue following the disputes over the issue of formation of the bench.
Objecting to the formation of the bench, Attorney General Ramesh Badal, former Attorney General Agni Prasad Kharel, and senior advocate Sushil Panta took exception to the formation of the bench stating that the justices who did not wish to remain on the bench were kept. The bench was formed today itself.
Advocates Rajaram Ghimire, Yagya Mani Neupane, Deepak Mishra, and Krishna Prasad Bhandari had submitted a writ petition along with a claim that 11 justices should not hear the case relating to HoR dissolution.
Chief Justice Rana had urged to withdraw the petition. A total of 30 writ petitions have been filed over the dispute. Twenty-six writ petitions of 146 members of dissolved HoR are in favor of reinstatement of HoR.
