Constitutional Bench to hear House dissolution case today

CJ Rana likely to form a new Constitutional Bench

KATHMANDU: The Constitutional Bench of the Supreme Court (SC) will hear the case against the dissolution of the House of Representatives (HoR) from today.

President Bidya Devi Bhandari had dissolved the HoR on May 22 and announced the election on the recommendation of the government.

Chief Justice Cholendra Shamsher Rana had earlier said that a new Constitutional Bench would be formed to hear the case on Sunday.

Judges Tej Bahadur KC and Bam Kumar Shrestha — earlier included in the Constitutional Bench constituted by Chief Justice Rana – had come under controversy as advocates pleading in favor of the writ petitioners had objected to the two judges in the court.

Justices Ananda Mohan Bhattarai and Deepak Kumar Karki had decided not to be included in the bench after Justices KC and Shrestha remained adamant to remain in the bench despite the controversy.

CJ Rana had on Friday said that he would call a meeting of the full court and form a new Constitutional Bench on the basis of seniority among the judges on the roster.
