Writ filed at SC against newly-appointed office bearers of constitutional bodies



KATHMANDU: A writ petition has been filed at the Supreme Court (SC) demanding to prohibit the heads and office bearers of various Constitutional Bodies from assuming their duties.

Senior Advocate Dinesh Tripathi filed a writ petition on Wednesday seeking prohibition of 32 heads and office bearers of the constitutional bodies who took oath of office and secrecy on Wednesday morning.

In the writ petition, Advocate Tripathi has demanded an order not to implement the decision of the Constitutional Council.

It has been mentioned in the writ that the ordinance brought by the government has violated Articles 2, 83, 284 and 292 of the Constitution.

According to Tripathi, the ordinance on the Constitutional Council (CC) is unconstitutional saying that three out of the six members of the CC cannot make a decision and the constitution does not envisage appointments to those commissions without a parliamentary hearing.
