SC judges ‘agree’ to look into habeas corpus case after 8 days of agitation

KATHMANDU: The Supreme Court (SC) Judges, who had been boycotting the benches assigned by Chief Justice Cholendra Shumsher Rana seeking his resignation, have agreed to look into the habeas corpus cases after eight days of agitation.

According to SC sources, an informal meeting of the SC judges held this morning decided to take a softer stand after Chief Justice Rana opted for a ‘graceful exit’.

Earlier, the judges had formed a three-member team to hold talk with Chief Justice Rana and seek his view for the way out from the impasse formed after the Chief Justice refused to resign and listen to the demands of the judges.

The team comprising three justices, including Sapana Pradhan Malla, had held a talk with Chief Justice Rana on Sunday evening and had briefed the judges about the discussion in the Monday morning’s meeting. Justices Anil Kumar Sinha and Dr. Manoj Kumar Sharma were the other members in the team.

Chief Justice Cholendra Shumsher Rana scheduled six writ petitions related to habeas corpus for hearing Monday.

The hearings on the cases of the Supreme Court have been affected after SC Justices boycotted the benches. Chief Justice Rana did not assign himself to any benches today.

Similarly, the Supreme Court which was scheduled to issue a final verdict on the writ petition filed against former prime ministers Madhav Kumar Nepal and Dr Baburam Bhattarai has been deferred.

A joint bench of Chief Justice Rana and Justice Nahakul Subedi on October 4 had heard and scheduled its final verdict for today.

The final verdict on the high-profile Lalita Niwas Land scam has been stalled since Justice Subedi is on leave. Subedi is in New Delhi-based Apollo Hospital for the treatment of his father, said Supreme Court.
