KATHMANDU: A writ has been registered at the Supreme Court (SC) on Monday alleging that the Prime Minister who has turned caretaker after the dissolution of the House of Representatives expanded the Council of Ministers going against the constitution.
Advocates Lokendra Oli, Keshar Jung KC, and Dinesh Lamichhane have filed the writ petition demanding an immediate halt to the Cabinet expansion.
The apex court will conduct the first hearing on the case on Wednesday.
Advocate Oli said that Article 77 (1) of the constitution does not allow a person who is not a member of the House of Representatives to be the Prime Minister and that the Council of Ministers cannot be expanded as the House has been dissolved.
It is mentioned in the writ that the President has seriously failed to fulfill her major duty of protecting the constitution.
Prime Minister KP Sharma Oli on Friday had inducted eight new ministers and one state minister into the Cabinet and also reshuffled the ministries of incumbent ministers.
