Writ filed at SC against recommendation by Constitutional Council



KATHMANDU: A writ has been filed at the Supreme Court (SC) on Tuesday against the Constitutional Council’s latest recommendation for the fulfillment of various posts lying vacant in various constitutional bodies.

Seeking that the apex court should quash the recommendation ‘which provoked the unconstitutional move’, advocate Sulav Kharel has filed a writ at the court.

The meeting of the Constitutional Council held on December 15 had decided to recommend 45 office bearers in various constitutional bodies.

Out of six members of the council, only three including Prime Minister KP Oli, Chief Justice Cholendra Shumsher Rana and Chairperson of National Assembly Ganesh Prasad Timilsina had attended the meeting.

As the post of Deputy Speaker at the House of Representative (HoR) was lying vacant for long , only five members could attend the meeting.

However, amending the provision of mandatory provision of all incumbent members, PM Oli had recently introduced an ordinance.

The ordinance changed the provision of a unanimous decision for the recommendation and made it that the decision could be made by the majority of the people.

Based on the ordinance, PM Oli had called the meeting without inviting the Speaker of HoR Agni Prasad Sapkota. Main Opposition Party Nepali Congress leader in the parliament Sher Bahadur Deuba was also not present in the meeting.

Disregarding the provision of informing the Council members 48 hours prior to the meeting, PM Oli had called the meeting in short duration so that the ‘unwanted’ opposition leader and the Speaker would not join the meeting.
