Punishment for rape extended, conciliator to be jailed for 3 years



KATHMANDU: The government will introducing a new law through an ordinance that would extend the provision of a jail term by six months to three years for people involved in communication mediation in rape cases.

The government is introducing a new law that will make people involved in the community settlement of rape cases also face criminal cases.

Minister for Law, Justice and Parliamentary Affairs Shivamaya Tumbahangphe informed that the ordinance was recommended to the President by the cabinet meeting held on Sunday. The ordinance Will be implemented after verification by the President.

According to law ministry sources, the ordinance is being issued after the amendment of the Senior Citizens Act, the Criminal Code, and the Criminal Procedure Code.

The ordinance has provided punishment for admitting that a male can also be raped.

Earlier, the word “girl” or “woman” was used in the penal system, but the word “person” has been added to it by amending it through an ordinance.

It was made public that a man had raped and killed a five-year-old boy in Janakpur in the third week of September. It is also mentioned in international practice that anybody can be raped irrespective of sex.

The ordinance has a provision of imprisonment of six months to three years or a fine of Rs 30,000 or both for conciliation in rape cases. If the mediator holds a public office, he will be imprisoned for an additional six months.

The punishment for rape has also been increased through the ordinance. Rape is now punishable up to 12 to 16 years in prison if a 14-year-old to 14 to 16-year-old is raped. Earlier, the punishment for such crimes ranged from 12 to 14.

Similarly, a person between the ages of 16 and 18 will be sentenced to 10 to 14 years imprisonment for rape. Earlier, such crimes were punishable by 10 to 12 years in prison.

Rape of a person 18 years of age or above is punishable by 10 to 12 years in prison. Earlier, such offenses were punishable by imprisonment for seven to 10 years.

If a minor (under 18 years of age) has been raped or attempted rape, but if no complaint has been lodged, a complaint can be lodged within one year of becoming an adult.
