SC hearing writ petition against Constitutional Council Ordinance today

KATHMANDU: The Supreme Court (SC) is hearing the writ petition filed against the Constitutional Council Ordinance brought by the government today.

Senior Advocate Dinesh Tripathi and Advocate Om Prakash Aryal had filed separate writ petitions at the SC against the ordinance on Wednesday arguing that the ordinance brought by the government unhinged the state organs and falsified the constitution.

The Office of the President, the Prime Minister, the Council of Ministers and the Constitutional Council have been mentioned as defendents in the writ petition.

A constitutional bench of the SC  is hearting the writ petitions today, Senior Advocate Tripathi informed through his Facebook. The cabinet meeting on Tuesday brought a new ordinance.

President Bidya Devi Bhandari on the same day issued the Ordinance on the Constitutional Council (Works, Duties, Rights, and Procedures) on the recommendation of the Council of Ministers in accordance with Article 114 (1) of the Constitution.

The Constitutional Council chaired by the Prime Minister has the leader of the main opposition party, Chief Justice, Speaker, Chairman of the National Assembly, and the Deputy Speaker as members.

After the issuance of the ordinance, the meeting can be held if the majority of members of the Constitutional Council are present.
