Supreme Court orders release of Mahottari inmate if not wanted in any other case

KATHMANDU: The Supreme Court has ordered the immediate release of Laxmi Mahato Koiri, currently held at Mahottari Prison, if he is not required to remain in custody in connection with any other case.

The directive was issued in response to a habeas corpus petition filed by Koiri’s son, Manoj Kumar Mahato, challenging his detention.

According to a letter issued by the Supreme Court’s Writ Division (Writ-6) on Thursday, the Mahottari Prison Office in Jaleshwar has been instructed to implement the court’s order without delay.

The petition had named the Gaushala Area Police Office in Mahottari and other authorities as respondents.

In its order, the apex court stated that Koiri must be released on the same day if there are no other legal grounds requiring his detention.

The Supreme Court said certified copies of the order have also been sent to the concerned authorities, including the Gaushala Area Police Office, Mahottari District Police Office, Mahottari District Court, and the Janakpur High Court, for implementation and information.
