SC bars local levels’ office-bearers to receive pay and perk

KATHMANDU: The Supreme Court (SC) has issued a verdict that local governments have been providing pay and perks to office-bearers and members of the local levels unlawfully.

A Constitutional Bench comprising of Chief Justice Cholendra Shumsher JBR, Justices Deep Kumar Upadhyaya, Kedar Prasad Chalise, Meera Khadka and Hari Krishna Karki issued a verdict that office-bearers and members of the local levels have been receiving pay and perks was against the constitution.

Hearing a writ filed by advocate Lokendra Bahadur Oli, the apex court annulled the annexes under Clause 3 of the acts related to pay and perks formulated by Province 2, Province 3, Gandaki Province, Province 5, Karnali Province and Sudurpaschim Province.

The apex court maintained that the acts were against Article 220 (8) and Article 227 of the constitution, according to advocate Oli.

The petitioner had named the governments of Province 2, Province 3, Gandaki Province, Province 5, Karnali Province and Sudurpaschim Province, Ministry of Internal Affairs and Law of those provinces as defendants.
