KATHMANDU: The Supreme Court’s hearing on the writ petition filed by Janata Samajwadi Party (JSP) Nepal Chairman Upendra Yadav has been assigned to the Full Bench.
The petition, filed by Yadav against the faction led by Ashok Rai and the recognition given by the Election Commission, was ordered to be referred to a full bench by a division bench of Justices Hari Prasad Phuyal and Til Prasad Shrestha.
Earlier, a single bench of Justice Binod Sharma had issued an interim order, on May 9, to maintain the status quo on the activities following the party split and summoned both parties for a discussion on May 21.
Yadav approached the Supreme Court dissatisfied with the Election Commission’s recognition of the Ashok Rai-led JSP as the official party.
Following the split in JSP Nepal, Yadav’s faction retains only 5 of the 12 lawmakers, while Rai’s faction has 7 lawmakers.
After leaving the government, Yadav has sought the invalidation of the other faction’s legitimacy through the court.
