SC upholds interim order in favor of Tarai Madhes Loktantrik Party against EC

KATHMANDU: The Supreme Court has reaffirmed the interim order favoring the Tarai Madhes Loktantrik Party (TMLP), blocking the Election Commission’s decision to alter its name.

A division bench comprising Justices Prakashman Singh Raut and Sunil Kumar Pokharel upheld the interim order, allowing TMLP to retain its name.

Previously, on March 17, a single bench led by Justice Bishowambar Prasad Shrestha had issued a temporary interim order, instructing the Election Commission to provide rationale for its decision alongside TMLP.

Advocate Satish Kumar Jha, representing TMLP, presented arguments in court.

The party has contended that the Election Commission’s directive to refrain from altering the party’s name with terms conflicting with the constitution and laws lacks merit.

According to constitutional provisions and existing laws, the party, registered on November 24, 2020, obtained its registration certificate on December 3, 2021.
