SC hearing Koshi CM Thapa-related writ today



KATHMANDU: The final hearing of the writ challenging the vote of confidence granted to Koshi Province Chief Minister Uddhav is scheduled to take place today (Monday).

Initially scheduled to be heard by Justices Sapana Malla Pradhan and Sushma Lata Mathema on Sunday, Thapa’s advocates requested a hearing by a full bench.

As a result, the hearing has been rescheduled to commence today without addressing the substantive matters of the case.

The writ, filed by Hikmat Karki, the parliamentary party leader of the main opposition party CPN-UML, was submitted to Judges Ishwor Prasad Khatiwada and Sushmalata Mathema’s bench last Sunday.

However, Judge Khatiwada declined to accept it, leading to the rescheduling of the hearing for Sunday.

On August 23, CPN-UML parliamentary party leader Karki lodged a writ with the Supreme Court, alleging that Chief Minister Thapa, who also leads the Nepali Congress, had violated the constitution by securing a vote of confidence.

The writ contends that a senior member, who presided over the state assembly, participated in the vote of confidence.

Subsequently, on August 24, a single bench presided over by Justice Ishwar Prasad Khatiwada ordered Thapa to continue functioning solely as the chief minister.
