SC to hear petition challenging Koshi Province CM Thapa’s appointment today



KATHMANDU: The Supreme Court (SC) is slated to deliberate on a petition lodged by former Chief Minister of Koshi Province, Hikmat Karki.

The petition contests the appointment of Uddhav Thapa as the Chief Minister of Koshi Province and is scheduled for today.

On Wednesday, Karki filed a writ petition with the SC, asserting that the vote of confidence in favor of Uddhav Thapa’s appointment as Chief Minister of Koshi Province was unconstitutional.

Karki names Koshi Province Chief Parshuram Khapung and Chief Minister Thapa as the defendants in the case.

In the petition, Karki has contended that it was unconstitutional to include the vote of the Assembly Chair when determining the confidence motion in the Koshi Province Assembly on August 21.

He has urged the SC to issue a mandamus order in his favor, thereby facilitating his appointment as Chief Minister in accordance with Article 168(3).

Karki’s argument is rooted in Thapa’s failure to secure a successful floor test as stipulated by the constitution.
