Only the parliament can decide CJ’s impeachment proposal: Shambhu Thapa

KATHMANDU: Senior advocate and former President of Nepal Bar Association Shambhu Thapa has said that no other authority except the parliament itself can decide on the impeachment motion presented in the House of Representatives (HoR).

Earlier, the Parliament Secretariat issued a letter, on Wednesday, stating that the impeachment against Chief Justice Cholendra Shumsher Rana submitted to the then HoR has become ineffective with the expiring of the HoR’s tenure.

However, Senior Advocate Thapa remarked that the parliament secretariat’s letter is invalid as the petition has not been submitted to the newly elected parliament yet.

“Since the term of the then HoR ended, the Parliament Secretariat cannot send it to the accused and ask him to carry out regular work considering the impeachment motion ineffective,” he said.

He clarified that the impeachment motion would be transferred to the newly elected parliament and the parliament would take actions ahead.
