Former Judges Forum-Nepal seeks probe into incompetent judges

KATHMANDU: The Former Judges Forum-Nepal has asked for a probe into the judges working at the Supreme Court (SC) and High Courts after getting appointments but are incompetent in the justice delivery.

Releasing its recommendations on Sunday for the reform in the judiciary, the Forum has stated that a high-level commission should be formed to probe into the appointments of the incompetent judges.

The Forum has mentioned that the existing process and system for the appointment of the judges was a highly disputed issue while calling for a revision of the current structure of the Judicial Council. The Chief Justice should lead the Council with four senior justices of the SC as the Council members, according to the Forum.

A constitutional provision should be ensured for the appointment of the CJ and justices/judges of all levels of courts at the recommendation of the Judicial Council and the Council itself should be entrusted with the right to form a probe panel to investigate the complaints lodged regarding the CJ and other justices/judges.

The Forum has also suggested that the provision of CJ being a Member of the Constitutional Council should be reviewed and the system of the parliamentary hearing for the appointment of the justices/judges should also be scrapped.
