Election Code of Conduct:  Resignation mandatory prior to becoming candidate



KATHMANDU: Incumbent representatives have to resign from their posts prior to becoming candidates for the local level elections.

As per the Election Code of Conduct, 2078 issued on Thursday, sitting representatives are not allowed to become candidates for the upcoming local level elections to be held on May 13.

The representatives have to submit a resignation letter while filing nominations.

Election Commission Chief Election Commissioner Dinesh Kumar Thapaliya said representatives willing to become candidates for the upcoming local level elections have to first resign.

“The representatives willing to become candidates have to resign and as per the local level election code of conduct,” said Thapaliya, adding, “The sitting representatives cannot become candidates in the local level elections.”

The section 36 of the Election Code of Conduct, 2078 published on Thursday has stipulated that the sitting representatives willing to become candidates have to resign prior to filing nomination of candidacies.

The Commission has formulated the Election Code of Conduct in agreement with all the concerned bodies and the Ministry of Law which stipulates that representatives can become candidates only after resigning from the posts.
