SC hearing on writ related to Constitutional Bench

KATHMANDU: The Supreme Court (SC) is hearing on the writ petition demanding that the Chief Justice should remain mandatorily in the Constitutional Bench.

According to SC sources, a division bench of Justices Prakash Kumar Dhungana and Dr. Manoj Kumar Sharma has been assigned for the Friday’s hearing on the writ.

Earlier, the writ petition was heard in a single bench of Judge Hari Prasad Phuyal.

Justice Phuyal’s bench had also issued an interim order directing the defendant to submit a written reply.

The order had drawn controversy citing that a Single Bench could not direct to stall the hearing going on in the Constitutional Bench.

As per the order of Justice Phuyal’s bench, the hearing on the writ has been rescheduled after the opposition submitted a written reply.
