SC decision against spirit of constitution: UML leader and ex-AG Kharel



KATHMANDU: CPN-UML leader and former Attorney General Agni Kharel has remarked that the Supreme Court (SC) decision to reinstate the House of Representatives (HoR) is against the spirit and letter of the constitution. He also claimed that the decision had institutionalized personal arrogance and eroded the principle of separation of powers.

The SC Monday reinstated the parliament and ordered Nepali Congress (NC) President Sher Bahadur Deuba to become the prime minister. Also, it clarified that whip does not apply to parliamentarians while participating in the government formation process pursuant to Article 76 (5) of the constitution.

On the SC verdict, Kharel said, “This decision has tarnished the basic principles of constitutionalism, the principle of division and balance of power, that is, the principle of separation of powers.”

“The decision taken in the guise of the constitution and constitutional ethics is against the parliamentary system of government. I humbly say this is a foul goal.”
