Attorney General defends the HoR dissolution claiming it’s based on ‘Go to the People’ principle



KATHMANDU: Defending the dissolution of House of Representation, the Office of the Attorney General has said that the dissolution is based on ‘Go to the People’ principle.

Submitting a debate note to the Constitutional Bench hearing on the writ petitions related to the dissolution of House of Representatives, the Office of the Attorney General said that it is an international norm that the head of state should not be drawn into dispute under any circumstances and no questions should be raised in the court regarding the actions taken by the President.

The Attorney General’s note also mentioned that it is not the responsibility of the President to identify the signatures; but the Office held it natural for the President to update herself on whether a claimant for the post of Prime Minister can garner enough support in the parliament.

The Office has also argued that the court should not interfere in the political issues.

Like the Office of the Prime Minister, the office of the Attorney General has also compared the election with the proposed general convention of Nepali Congress and argued that the people can take part in the election as the NC cadres do for the general convention.

“The dissolution of the parliament is based on the principle of ‘go to the people’,” the Attorney General said defending the PM’s move, adding, “There is nothing to be skeptic about the intention of the Prime Minister and the President in this regard.”
