KATHMANDU: The Supreme Court (SC) is hearing writ petitions filed against the dissolution of House of Representatives (HoR) on Thursday, too.
Advocates who began delivering their arguments on Wednesday are continuing their arguments on the writ petition on behalf of 146 lawmakers led by Nepali Congress President Sher Bahadur Deuba.
Senior advocates Raman Shrestha, Harihar Dahal, Dinmani Pokharel, Sunil Pokharel are delivering their arguments. Each one will be provided one hour for presenting their arguments on the writ.
Advocates on Wednesday questioned over the roles of President Bidya Bhandari claiming that she was found more active in politics rather than becoming ceremonial.
Senior Advocate Khamba Bahadur Khati questioned at the President Bidya Bhandari’s call for the formation of a new government in line with Article 76 (5) bypassing Article 76 (4) of the Constitution even when only 93 lawmakers were in support of PM Oli when he took a vote of confidence for the first time.
Delivering his arguments on the writ petition against the dissolution of the HoR on Wednesday, Advocated Khati demanded a mandamus in the name of the President for the appointment of NC President Deuba as the Prime Minister.
On May 21, NC President Deuba had staked a claim for the post of Prime Minister with support of 149 lawmakers from CPN (Maoist Center), Nepal-Khanal faction of CPN-UML and Yadav-Bhattarai faction of Janata Samajwadi Party (JSP).
Prime Minister KP Oli also claimed the majority for the Prime Minister with the support of JSP and the UML Parliamentary Party.
President Bhandari, then, turned down both the claims stating that lawmakers were repeated in the lists furnished by both Oli and Deuba, thereby paving the way for the HoR dissolution.
On May 22, President Bhandari officially dissolved the HoR and announced the dates for mid-term polls on the recommendation of the cabinet.
