NBA and Supreme Court Bar Association recommend representatives to Amicus Curiae



KATHMANDU: Nepal Bar Association (NBA) and the Supreme Court Bar Association have recommended four senior advocates to represent the Bar Association in Amicus Curiae to hear petitions against the dissolution of the House of Representatives.

According to sources, NBA has sent senior advocates Raghav Lal Baidya and Usha Malla Pathak, and  the Supreme Court Bar has sent senior advocates Komal Prakash Ghimire and Prakash Bahadur KC for the Amicus Curiae.

Senior Advocate Baidya had been an attorney general during the premiership of CPN-Maoist Center Chairman Pushpa Kamal Dahal, whereas senior advocate Pathak is a former vice-president of the Association.

The lawyers recommended by the Supreme Court Bar are also the senior advocates with wide experience of hearing constitutional and other issues.

On the recommendation of Prime Minister KP Oli, President Bidya Devi Bhandari dissolved the House of Representatives at midnight on May 21 and called for mid-term elections in November.

As a response to it Supreme Court received as many as 30 writ petitions related with the dissolution of the House of Representation. Most of them, including the ones submitted by the opposition alliance which had presented Nepali Congress President Sher Bahadur Deuba as their Candidate for Prime Minister, have sought the reinstatement of the parliament.

Hearing the case, a constitutional bench of Chief Justice Cholendra Shamsher Rana, Justices Deepak Kumar Karki, Mira Khadka, Ishwar Prasad Khatiwada and Ananda Mohan Bhattarai had ordered for amicus curiae with two members each from the Nepal Bar Association and the Supreme Court Bar Association.

As per the Supreme Court order the Bar Association has sent the representatives.
