Supreme Court to hear writs against HoR dissolution on Thursday and Friday

KATHMANDU: The Supreme Court (SC) has scheduled the dates for hearing 30 writ petitions filed against the dissolution of the House of Representatives (HoR) for Thursday and Friday.

According to information expert of the SC Kishor Paudel, 19 writs petitions have been scheduled for hearing on Thursday (May 27) and the 11 on Friday.

Similarly, out of 30 writs, 19 have been filed seeking an interim order on the HoR dissolution while 11 writ petitions have been filed demanding that the writs should be heard through the Constitutional Bench.

Most of the cases have been filed demanding reinstatement of the HoR while a few of them have been filed in favor of Prime Minister KP Sharma Oli seeking timely conduction of the elections.  The bench to hear the writ petitions will be fixed on the respective days, the SC said.

After President Bidya Devi Bhandari ruled that there was no basis for the appointment of the Prime Minister as per Article 76 (5), the parliament was dissolved Friday night by the President on the recommendation of the Council of Ministers and the date of the election was fixed on November 12 and 19.

Stating that the dissolution of the parliament is unconstitutional, as many as 146 lawmakers Monday filed a writ petition at the apex court demanding the appointment of Sher Bahadur Deuba as the prime minister as per Article 76 (5) of the Constitution.
