SC issues urgent interim order in favor of four Lumbini JSP lawmakers



KATHMANDU: The Supreme Court has issued an emergency interim order not to implement the decision of the Speaker of the Lumbini Provincial Assembly (PA) that dismissed four lawmakers of the Janata Samajwadi Party (JSP).

A single bench of Justice Nahkul Subedi on Monday, hearing on the writ filed by four provincial lawmakers who were relieved of their parliamentarian status in Lumbini PA, ordered not to sack JSP lawmakers Santosh Kumar Pandey, Bijay Bahadur Yadav, Suman Sharma Rayamajhi and Kalpana Pandey.

After the four joined the Lumbini government against the party’s decision, a meeting of the majority members of the Executive Committee of JSP decided to expel them from the party and the JSP had sent a letter stating the expulsion to Lumbini PA. On the basis of that letter, the Speaker had relieved them from their parliamentarian status.

The four lawmakers had filed a writ petition seeking reinstatement of their parliamentarian status raising questions on the party decision’s legitimacy.

The SC order has stated that it is not clear if the executive committee gave them the chance to present clarification and it was necessary to discuss the issue with stakeholders concerned to issue an interim order. However, it has not set a date for the next hearing.
