Advocates demand SC to curb PM Oli’s statement that the parliament cannot be reconstituted



KATHMANDU: Taking part in the debate in the Supreme Court’s constitutional bench on the issue of dissolution of the parliament, advocates have demanded that Prime Minister KP Oli’s comment that the parliament cannot be reconstituted has to be checked by the court now as the remark is the violation of the jurisdiction of the court.

During Wednesday’s hearing on the court, advocate Kanchan Krishna Neuapane, one of the writ petitioners, demanded to stop Prime Minister Oli’s statement that the parliament cannot be reinstated.

“It has come to our notice that the jurisdiction of the court has been exceeded by the remarks of the Prime Minister, hence, such statements should be stopped,” Neupane argued before the bench hearing the case.

Justice Anil Kumar Sinha responded to Neupane’s claim saying the court does not notice anything going outside the court and its concern is confined to the things said in the bench.

Advocate Neuapane argued that the PM cannot speak thus about the issue in public places.

He reiterated that the constitution has granted mentioned the tenure of the parliament as five years.

Unlike on other days, six advocates including senior advocate Chandra Kanta Gyawali and Krishna Prasad Bhandari took part in the hearing on Wednesday.

They argued that the House of Representatives has to be reinstated as no provisions in the constitution support the Prime Minister’s present move.

Wednesday’s session also is over keeping the hearing on the issue of dissolution of the HoR at ‘on-hearing’ status.
