Govt denies taking HoR dissolution case to Extended Full Bench

KATHMANDU: The government side has disagreed to take the writ petitions seeking the restoration of the House of Representatives (HoR) to the Extended Full Bench from the ongoing hearing in the Constitutional Bench.

Resuming the hearing on the petitions against the dissolution of HoR on Wednesday, Chief Justice Cholendra Shumsher Rana asked the government side if it would consent to taking the ongoing hearing in Constitutional Bench to the Extended  Full Bench.

Responding to the CJ’s question, Attorney General Agni Kharel replied that they would not give consensus to shift the hearing to the extended full bench.

Following the disagreement of the government side, there is a debate on whether the petition against the dissolution of the HoR should be heard through the Constitutional Bench or decided by the Full Constitutional Bench.

The constitutional bench has given one hour to the petitioners to further plan on the issue.

Former Attorney General and Senior Advocate Raman Shrestha have raised the issue of jurisdiction and advocated that the cass has to be taken to the extended full bench.

Chief whip of ruling Nepal Communist Party (NCP) Dev Prasad Gurung, one of the petitioners of the case, is also taking part in today’s hearing.
