KATHMANDU: The Constitutional Bench of the Supreme Court (SC) will conduct the next hearing on the writ petitions filed against the government’s move to dissolve the House of Representatives (HoR) on Wednesday.

The bench decided to conduct the next hearing on January 13.

The SC had formed a five-member Constitutional Bench led by Chief Justice (CJ) Cholendra Shumsher Rana for hearing the writs.

It will give a final verdict on the issue of whether the HoR dissolution was in line with the constitution or not.

The writs were registered at the Supreme Court against the decision naming the Office of the President, Office of the Prime Minister, and the Council of Ministers and House Speaker as defendants.

It may be noted that President Bidya Bhandari had dissolved the HoR on the recommendation of Prime Minister KP Sharma Oli on December 20.

Meanwhile, Justice Hari Krishna Karki has decided not to sit in the Constitutional Bench formed to hear the case against the dissolution of the House of Representatives.

Karki decided not to sit in the bench after legal practitioners raised questions about his presence in the bench.

Senior advocates Shambhu Thapa, Mukti Pradhan, Krishna Prasad Bhandari and others had questioned the presence of Karki in the five-member Constitutional Bench. After that, Karki announced that he would not sit in the bench.

The apex court stated that the case will be heard in the bench and another Justice will be added.

Karki was the Attorney General during PM KP Oli’s first term as Prime Minister. Prime Minister Oli is of the defendant in the case.
