KATHMANDU: The Parliamentary Hearing Committee is conducting a hearing on proposed Chief Justice Manoj Kumar Sharma. The committee has been discussing complaints filed against Sharma since Tuesday morning.
The committee has summoned Sharma for discussion today. However, he has already submitted his action plan to the committee.
In the action plan, Sharma has expressed his commitment to making the appointment process for judges transparent.
“The recommendation process for the appointment of judges by the Judicial Council will be based on a merit system so that it can be objectively established that the criteria set by the Constitution and laws have been fulfilled. For this, objective standards for measuring qualifications, capability, experience, and judicial integrity in accordance with the Constitution and laws will be identified and developed. A system will be established to ensure appointments are dispute-free, transparent, and predictable,” the action plan states.
Sharma has also stated that vacant judicial posts will be filled within the timeframe specified by the Constitution and laws. He further mentioned that schedules would be prepared and regular meetings of the Judicial Council would be held for this purpose.
He has also argued that, except in extraordinary situations requiring subject-specific expertise, appointments to the Supreme Court should generally be made from among High Court judges.
Sharma has proposed giving priority to district judges and serving judicial officers for appointments to the High Court. He has also outlined plans to reform the process of appointing judges in district courts by prioritizing candidates with experience working as bench officers while ensuring inclusiveness in appointments.
