Supreme Court defers hearing on writ challenging government–Gen-Z agreement



KATHMANDU: A writ petition filed at the Supreme Court challenging the constitutionality of the 10-point agreement signed between the government and the Gen-Z movement has been listed as ‘not heard’ on Monday.

Although the case was scheduled for hearing before a joint bench of Justices Abdul Aziz Musalman and Sunil Kumar Pokhrel, it could not be taken up due to the bench being occupied with other cases.

Earlier, on December 19, a single bench of Justice Tek Prasad Dhungana had issued a show-cause order in the name of Prime Minister Sushila Karki, asking the government to submit a written response through the Office of the Attorney General within 15 days regarding the agreement.

Separate writ petitions were filed by advocate Dr Prem Raj Silwal and by advocates Sudip Bhandari, Rohit Jha, Saroj Kattel, along with law students Ayush Badal, Prabin Paudel and Smriti Adhikari. The petitioners have argued that the agreement is unconstitutional.

The writ petitions challenge the agreement signed on December 10 between Prime Minister Sushila Karki and representatives of the Gen-Z movement, raising constitutional questions over the authority of an interim election government to enter into political and structural agreements with long-term and far-reaching implications.

The petitioners contend that such an agreement exceeds the constitutional mandate of the current government and undermines established constitutional procedures.
