Hearing scheduled in Supreme Court on Madhesh CM Saroj Yadav’s appointment challenge



KATHMANDU: The Supreme Court has scheduled a hearing on the writ petition challenging the appointment of Madhesh Province’s newly appointed Chief Minister Saroj Kumar Yadav. The case will be heard in the bench of Justice Nityananda Pandey.

The petition was filed by 74 provincial assembly members from parties other than UML, contesting the appointment of Yadav under Article 168(3) of the Constitution by then-Province Chief Sumitra Subedi Bhandari. Yadav, leader of the UML Madhesh Province parliamentary party, was sworn in at a hotel in Bardibas on Monday.

The petitioners argue that, under Article 168(2) of the Constitution, the Province Chief should appoint a leader who has the potential to form a majority government. They claim that appointing the leader of the largest party without majority support is inappropriate and should be revoked.
