KATHMANDU: The Nepal Bar Association (NBA) has expressed serious concern over the government’s decision to recall an ambassador while the matter is pending before the Supreme Court.
In a press release issued on Wednesday, NBA General Secretary Kedar Prasad Koirala noted that the recall order comes at a time when the Supreme Court is considering the case and has issued an interim order, and the ambassador has been directed to report to the Ministry of Foreign Affairs for duties.
“The act of indirectly or directly ignoring a court’s order promotes arbitrariness,” the statement said. “We earnestly appeal to all concerned to follow the court’s order or verdict strictly and refrain from any actions that could undermine public trust in the judiciary.”
The NBA emphasized that while healthy academic or legal discussions on a court ruling are allowed, compliance with court decisions, directly or indirectly, is the duty of all.
The statement further warned that any action contradicting the court’s order, based on constitutional provisions, the principle of constitutionalism, independent judiciary, or Article 128(4) of the Constitution, not only disrespects the court but also weakens the rule of law.
