Mukul Dhakal challenges RSP’s decision at Election Commission



KATHMANDU: Dr. Mukul Dhakal, the suspended General Secretary of the Rastriya Swatantra Party (RSP), has appealed to the Election Commission (EC) to refrain from processing any correspondence related to his suspension.

In a letter submitted to the Election Commission on Sunday, Dhakal asserted that he was unaware of his purported dismissal.

He denounced any such communication as unlawful and requested that it not be processed.

Dhakal urged the Election Commission to disregard any letters received for updating purposes, citing Section 51 of the Political Parties Act, 2073, which allows for a 30-day period for such updates.

He further argued that, according to sub-section (2) of Section 18 of the Political Parties Act, he was not afforded a fair opportunity to present an apology.

“The Constitution of Nepal enshrines democratic principles, which universally mandate that due process must be observed for justice. The Political Parties Act 2073 also stipulates that actions taken without offering a chance for justice are deemed illegal,” Dhakal stated.

Additionally, Dhakal emphasized that any party meetings conducted without his authorization or presence are considered illegitimate.

“Since I have not authorized any central committee member or official to convene meetings, any such meetings held in my absence or without my consent will be deemed illegal,” he stated.
