KATHMANDU: Former Chief Justice Kalyan Shrestha has emphasized the need for proper implementation of the Constitution before considering any revisions or reviews.

Speaking at a discussion program on ‘Constitutional Implementation: Expectations and Reality,’ jointly organized by the Constitution Watch Group and the Institute for Strategic and Socio-Economic Science Research (ISSR) in Kathmandu on Monday, Shrestha pointed out ongoing issues with constitutional implementation and federalism.

“There are still problems in the implementation of the constitution, thus enjoying the rights provided by the Constitution. While everyone is ready for an open debate, we must first ensure its proper implementation,” he said. He also noted contradictions within federalism, which have raised doubts about its effectiveness.

“Due to its contradictory nature, the implementation of federalism has also been questioned. People have started raising questions about federalism,” he said.

“Inclusion is the most important value in this constitution. But we have to redefine inclusiveness”, he said, “Inclusiveness was designed to uplift those traditionally left behind, but some traditional beneficiaries have taken advantage of it. We need to redefine inclusiveness to focus on prosperity.”

The former Chief Justice also underlined the need for equal treatment in the legal system and the importance of fostering a culture of law obedience to ensure the ‘Rule of Law.’

Shrestha said that an atmosphere of consensus among all is needed when the constitution is reviewed. “The Constitution cannot be revised in a win-lose environment. A consensus government is needed if we are to reach an agreement on amendments,” he concluded.
