Legal challenge to PM Oli’s appointment moves to constitutional bench

KATHMANDU: The case challenging the appointment of KP Sharma Oli, Chairman of the CPN-UML, as the Prime Minister of Nepal is now set to be heard by the Constitutional Bench.

The case, initially overseen by Judge Bal Krishna Dhakal, has been transferred to the Constitutional Bench for further proceedings.

The writ petition was filed on Monday by advocates Khagendra Chapagain, Shailendra Gupta, and Deepak Adhikari. The petitioners are seeking to annul Oli’s appointment and call for the appointment of a new Prime Minister as per Article 76(3) of the Constitution.

President Ram Chandra Paudel appointed Oli as Prime Minister under Article 76(2) of the Constitution last Sunday.

The petitioners argue that following the failure of outgoing Prime Minister Pushpa Kamal Dahal to secure a vote of confidence, the appointment of a new Prime Minister should have been made according to Article 76(3).

They also demand that the President appoint the parliamentary party leader of the largest party in the parliament as the new Prime Minister.

The petition names the Office of the President, the Office of the Prime Minister and Council of Ministers, the Secretariat of Parliament, and the House of Representatives as defendants in the case.
