KATHMANDU: The Supreme Court (SC) is conducting a hearing on the writ filed against the formation of the Koshi Province government today.
The full bench of the SC is presiding over the hearing regarding the writ, which challenges the formation process of the government led by Chief Minister Uddhav Thapa.
The petitioner, former Chief Minister of Koshi Province, Hikmat Kumar Karki, brought the case before the Supreme Court after expressing concerns over the appointment of Uddhav Thapa as Chief Minister, which included the signature of Speaker Baburam Gautam.
In response to the complexity of the legal question involved in the dispute, the bench of Justices Sushma Lata Mathema and Til Prasad Shrestha issued an order on Monday to refer the case to the full bench for resolution.
This decision is in accordance with rule 23 (c) of the rules of the Supreme Court, which allows for referral to a joint bench when a complex legal issue requires the expertise of a full bench.
