Expelled Pandey moves Supreme Court against Bibeksheel Sajha Chair Mishra and EC

KATHMANDU: Expelled Coordinator of Bibeksheel Sajha Party Milan Pandey has filed a writ petition in the Supreme Court against party Chair Rabindra Mishra and the Election Commission (EC).

The writ petition alleged that Chair Mishra illegally took action against Pandey in contravention to the party’s unification manifesto and statute. Chair Mishra also stands accused of evading the party’s unity convention as per the unity agreement, and releasing documents that do not share values of the party’s statute.

Meanwhile, the EC, another defendant, allegedly legitimized the unverified minutes submitted by Mishra and updated party details accordingly.

The writ has sought annulment of the action taken against Coordinator Pandey, and an interim order in the name of the leadership to run the party in line with its statute. It also called for overturning EC’s move of updating party details based on Mishra-provided documents.

Similarly, the writ also asked the court to decide regarding the party’s participation in local level elections slated for May 13. In terms of participation in local election, the writ urged the court to allow the 130-member Executive Committee that existed prior to September 2, 2021, to function until the final verdict on the case arrives.
