KATHMANDU: Senior advocate Shree Hari Aryal has argued that by accepting the unsolicited letter the President acted in bad faith.
Taking part in the debate related to the writ petition on the dissolution of the House of Representatives on Friday, the Senior Advocate Aryal alleged that the President acted in bad faith by siding with a leader from a party and disregarding the claims of another.
“The president has been dwelling upon the conditions not included in the Constitution and has been disregarding the spirit of it rather than acting as its guardian,” he said, citing, “ the Citizenship ordinance, constitutional ordinance, cabinet manipulation all have been consented and taken ahead favoring an individual.”
Senior Advocate Aryal said that the role of the head of state in convening the House of Representatives and activating the National Assembly was not appropriate.
“A vote of confidence is mandatory; it is binding. The President should not have recognized the unconstitutional letter of the Prime Minister,” he said, adding, “The president has not been given such a privilege. The Prime Minister’s move is not acceptable in the reformed parliamentary system.”
