HoR dissolution: Pleading on behalf of PM, Speaker concludes

KATHMANDU: Pleading on behalf of the Prime Minister and the Speaker in the writ petition filed against the dissolution of the House of Representatives (HoR) has come to an end.

Taking part in the hearing at the Supreme Court today, Prime Minister KP Sharma Oli’s legal advisor Baburam Dahal said the Prime Minister had the right to go to elections as per the constitutional provisions, after being not allowed to complete a five-year term.

“A Prime Minister with the two-thirds majority was not allowed to work, hence the HoR had to be dissolved,” he said.

Likewise, defending the Prime Minister advocates Bishnu Maya Bhushal and Ram Chandra Gautam said the King had the right to dissolve the house in the previous Constitutions which was now with the Prime Minister in the prevalent Constitution.

Pleading on behalf of the Speaker, senior advocates Laba Prasad Mainali, Shyam Prasad Kharel, and Shrikrishna Subedi said the Prime Minister was not obstructed in the HoR to carry out his duties.

The pleading on behalf of the writ petitioners will conclude on coming Sunday, and it will be followed by a pleading by the amicus curiae.

The amicus curiae consist of Badri Bahadur Karki, Satish Krishna Kharel, Bijaya Kant Mainali, Purna Man Shakya and Geeta Pathak.

The hearing is taking place at the Constitutional Bench of the Supreme Court led by Chief Justice Cholendra Shumsher JB Rana and including Justices Bishwombhar Prasad Shrestha, Anil Kumar Sinha, Sapana Malla, and Tej Bahadur KC.
