Protesting SC justices’ ultimate demand CJ Rana’s resignation; to resume hearing habeas corpus petitions

Won't sit in a division bench with Chief Justice



KATHMANDU: Supreme Court (SC) justices, who have been boycotting benches demanding the resignation of Chief Justice Cholendra Shumsher Rana, have reached an agreement Monday to hear habeas corpus writs only from Tuesday.

Nevertheless, the SC justices have not backed from their demand of CJ Rana’s resignation.

The consensus among SC justices comes at a time when CJ Rana is preparing to start regular benches with all types of cases.

The disgruntled judges agreed to hear habeas corpus cases but will not attend the division bench with the Chief Justice even in such cases. They also agreed to discard any other cases assigned except habeas corpus.

“We agreed today to continue hearing the cases of detainees from Tuesday; but will not share the bench with the Chief Justice and will not look into other cases, except that of detainees. We are consulting on other issues,” said Justice Hari Krishna Karki.

CJ Rana is preparing to resume hearing on all issues, including of the detainees, from Tuesday. However, the talks team formed by the SC judges conveyed to CJ Rana that the judges are not ready to look into cases other than habeas corpus.
