HoR dissolution: Same five-member Constitutional Bench hearing writs today

KATHMANDU: The Constitutional Bench (CB) is hearing the writ petitions filed againt the dissolution of the House of Represntives (HoR) on Tuesday.

Even though advocates and senior Justices had advised Chief Justice Cholendra Shumsher Rana to exclude two Justices Tej Bahadur KC and Bam Kumar Shrestha, no changes have taken places in the bench.

The same five-member bench lead by CJ Rana is hearing the case today.

Led by CJ Rana,  Justices Deepak Kumar Karki, Ananda Mohan Bhattarai, Bam Kumar Sharestha and Tej Bahadur KC are members in the bench.

Earlier, advocates were divided over the members of the bench. Some said Justices Shresth and KC were not eligible to hear the case since they courted controversies while the other group was of the view that questions shoud not be raised on Justices in that manner.

The hearing, which was underway on 30 writ petitions, was hit after questions were raised over two Justices in the CB Tej Bahadur KC and  Bam Kumar Shrestha.

Following a heated discussion between Chief Justice Cholendra Shumsher Rana and an advocate, CJ Rana had asked Justices KC and Shrestha to decide on their own whether to quit the bench.

According to a Supreme Court source, they will present their views on it in the CB today.

Five Justices on Monday had dwelled on this issue in the CB.
