KATHMANDU: Attorney General Agni Prasad Kharel has admitted that a Prime Minister having a majority cannot dissolve the parliament.
Taking part in the debate on behalf of the government in a writ petition against the dissolution of the House of Representatives Monday, Attorney General Kharel said that though he, too, believed that the majority government cannot dissolve the HoR, he is before the Constitutional Bench to defend the government.
“What I said in the media is correct. The majority-led government cannot dissolve the parliament. I reiterated my position.”
Attorney General Kharel said this before the Constitutional Bench hearing the debate on the writs against the dissolution of the House. “However, I am here to defend the government as the Attorney General.”
The Attorney General added that he could not escape from the constitutional duty of the attorney to defend the case.
A Member of the then Constituent Assembly, Kharel had also executed his duty as an expert member of the Constitution Drafting Committee.
The constitutional bench has taken note of Kharel’s video in which he is seen elaborating why and how the constitution has not given the right of dissolving the House to the Prime Minister.
