CIAA’s move to bring private sector under its purview unconstitutional: Koirala

KATHMANDU: Nepali Congress leader Dr Shekhar Koirala said the bill prepared by the Commission for the Investigation of Abuse of Authority (CIAA) to bring the private sector under its purview is unconstitutional.

Posting a twitter message on Tuesday, Koirala said the CIAA’s bill to bring the private sector under its purview is against the constitution as it has clearly stated that onluy ‘a person holing a public post’ falls under its purview.

“Article 239 of the Constitution of Nepal has clearly stated that only a person holding a public figure falls under the purview of CIAA,” said Koirala, adding, “To bring the bill despite having this provision indicates that the government is heading towards the path of totalitarianism”.

On Monday CIAA  tabled an amendment proposal to the existing CIAA Act, 2048 in the National Assembly, enabling it to investigate non-governmental organizations and public companies.

Legislation Management Committee submitted its report in the Upper House on Monday.

Once the report is endorsed by the National Assembly, it will go to the House of Representatives.
